The provisional duty takes effect immediately and applies to all subject imports, pending completion of the full anti-dumping investigation.

Who is affected

Importers of alkyl phosphonic acids and sodium salts thereof (HS Chapter 29) sourced from China face immediate duty collection at EU borders. The regulation names specific Chinese producers and exporting entities subject to the measure. All importers—whether direct from manufacturers or via intermediaries—must verify their supplier's status against the list of named entities in the implementing regulation.

Scope and duty application

Alkyl phosphonic acids and their sodium salts are industrial chemicals used in flame retardants, water treatment, and specialty applications. The provisional duty is imposed on all imports from China regardless of end-use, supplier identity, or declared value. The Commission stated the measure is necessary to prevent injury to EU producers during the investigation period.
