ITC Issues Exclusion Orders on Women's Flats With Colored Outsoles

The U.S. International Trade Commission has found a Section 337 violation involving certain women's flats with colored outsoles and issued both a general exclusion order (GEO) and limited exclusion order (LEO) to prevent importation of the infringing goods. The bond requirement is set at 100% of entered value during the Presidential review period. This determination bars affected products from U.S. entry unless they comply with the exclusion terms or receive a Presidential waiver.

ITC Issues Exclusion Orders on Women's Flats With Colored Outsoles

On June 8, 2026, the U.S. International Trade Commission announced a final determination of a Section 337 violation involving certain women's flats with colored outsoles. The Commission has issued both a general exclusion order (GEO) and a limited exclusion order (LEO) to enforce intellectual property rights and prevent the entry of infringing merchandise into the United States.

Orders and Enforcement Terms

Section 337 of the Tariff Act of 1930 protects U.S. intellectual property by authorizing the ITC to exclude infringing goods from importation. In this case, the Commission determined that covered articles violate Section 337 and took dual enforcement action:

The bond requirement during Presidential review has been set at 100% of the entered value of covered articles. This means importers must post a cash bond equal to the full customs value of the merchandise before goods can be released from CBP custody—a significant friction point for supply-chain operations.

What This Means for Shippers

If you import or handle women's flats with colored outsoles, verify immediately whether your suppliers and SKUs fall under the subject-merchandise description in this order. Any shipments matching the exclusion scope will be detained at U.S. ports and cannot enter commerce without a Presidential waiver or by demonstrating non-infringement. The 100% bond requirement makes test shipments or compliance verification expensive. Reroute sourcing to non-infringing designs, apply for a waiver if you have legitimate grounds, or halt affected imports now to avoid detention and forfeiture. Check the Federal Register entry for the complete product description and respondent list.
