US court overturns dumping margin for Turkish aluminum foil
On May 5, 2026, the U.S. Court of International Trade issued a final judgment in Assan Aluminyum v. United States that partially sustained and partially dismissed the Department of Commerce's antidumping determination on certain aluminum foil from Türkiye. As a result, Commerce is amending its final antidumping duty order to revise the weighted-average dumping margin for Assan Aluminyum Sanayi ve Ticaret A.S., Kibar Dis Ticaret A.S., and Ispak Esnek Ambalaj Sanayi A.S. (operating as the Assan Single Entity). The original investigation covered the period July 1, 2019 through June 30, 2020.

On May 5, 2026, the U.S. Court of International Trade (CIT) issued its final judgment in Assan Aluminyum Sanayi ve Ticaret A.S. v. United States (Consol. Court No. 21-00616), sustaining in part and dismissing in part the U.S. Department of Commerce's remand redeterminations in the antidumping investigation of certain aluminum foil from the Republic of Türkiye. The Federal Register notice published May 18, 2026 officially notifies the public that the CIT's judgment conflicts with Commerce's original Final Determination and announces an amended antidumping duty order.
What Changed
The original investigation examined sales at less than fair value (LTFV) of certain aluminum foil from Türkiye, covering the period of investigation from July 1, 2019 through June 30, 2020. Commerce initially issued a final determination assigning weighted-average dumping margins to respondent exporters. However, the CIT's decision on remand requires Commerce to revise those margins.
Affected Parties and HS Classification
The amended determination directly impacts three Turkish producers operating as the Assan Single Entity:
- Assan Aluminyum Sanayi ve Ticaret A.S.
- Kibar Dis Ticaret A.S.
- Ispak Esnek Ambalaj Sanayi A.S.
Aluminum foil falls under HS Chapter 76 (Aluminum and articles thereof). Importers and shippers handling aluminum foil originating from these three producers from Türkiye must use the revised dumping margins to calculate applicable antidumping duties on entries covered by the investigation period and the ongoing order.
