US initiates five-year sunset reviews on AD/CVD orders

The U.S. Department of Commerce has automatically initiated five-year (sunset) reviews of antidumping duty (AD) and countervailing duty (CVD) orders and suspended investigations under the Tariff Act of 1930, as amended. The U.S. International Trade Commission is publishing a concurrent notice of Institution of Five-Year Reviews covering the same orders and investigations. These periodic reviews determine whether existing trade remedy duties should remain in place or expire.

Automatic Initiation of Sunset Reviews on Trade Remedy Orders

On June 1, 2026, the U.S. Department of Commerce announced the automatic initiation of five-year (sunset) reviews on antidumping duty (AD) and countervailing duty (CVD) orders and suspended investigations. According to the Federal Register notice, "In accordance with the Tariff Act of 1930, as amended (the Act), the U.S. Department of Commerce (Commerce) is automatically initiating the five-year reviews (Sunset Reviews) of the antidumping duty (AD) and countervailing duty (CVD) orders and suspended investigations listed below."

What Are Sunset Reviews?

Sunset reviews are mandatory periodic examinations of existing trade remedy orders. Under U.S. law, AD and CVD orders must be reviewed every five years to determine whether the duties should continue or be allowed to expire. These reviews assess whether revoking the orders would likely lead to a recurrence of dumping or subsidization, and whether such recurrence would likely injure the domestic industry.

Concurrent ITC Notice

The U.S. International Trade Commission is publishing a concurrent notice of Institution of Five-Year Reviews that covers the same orders and suspended investigations subject to Commerce's review. Both agencies coordinate on these reviews to ensure comprehensive evaluation of trade remedy measures.

Affected Orders and Investigations

While the Federal Register notice does not enumerate specific orders and investigations in the text provided, interested parties should consult the full notice for the complete list of AD/CVD orders and suspended investigations undergoing review. Importers, exporters, domestic producers, and other stakeholders should monitor the Commerce and ITC notices for details on specific product categories and country sources affected.

Process and Timeline

Sunset reviews follow established procedures under the Tariff Act of 1930. Domestic interested parties typically have the opportunity to indicate whether they wish to participate in the review and to submit comments and factual evidence. The Commerce Department and ITC will conduct investigations and issue preliminary and final determinations regarding whether the duties should be revoked or continued.

What this means for shippers

Exporters and importers affected by existing AD/CVD orders must monitor these sunset reviews closely. If duties expire, your landed costs on currently-restricted merchandise could change significantly. Check the full Federal Register notice and ITC announcement for the specific orders under review, then verify your product classifications and current duty rates. Review /hs-codes/search to confirm whether your goods are covered by any orders slated for sunset review, and update your cost estimates accordingly as preliminary determinations are issued.
