US initiates full five-year review of phosphate fertilizer CVD orders

The U.S. International Trade Commission announced on 17 June 2026 that it will conduct full five-year reviews of existing countervailing duty (CVD) orders on phosphate fertilizers from Morocco and Russia. Under the Tariff Act of 1930, the Commission must determine whether revoking these orders would likely cause a recurrence of material injury to the domestic industry. US launches full five-year review of phosphate fertilizer CVD orders from Morocco and Russia

On 17 June 2026, the U.S. International Trade Commission (ITC) announced it will conduct full five-year reviews of the countervailing duty orders on phosphate fertilizers from Morocco and Russia, according to the Federal Register.

The Commission hereby gives notice that it will proceed with full reviews pursuant to the Tariff Act of 1930 to determine whether revocation of the countervailing duty orders on phosphate fertilizers from Morocco and Russia would be likely to lead to continuation or recurrence of material injury within a reasonably foreseeable time.

Under U.S. trade law, CVD orders are subject to automatic sunset reviews five years after imposition. The Commission must evaluate whether domestic producers would face material injury if the duties were removed. If the Commission finds that revocation would likely lead to a recurrence of injury, the orders remain in place; if not, they expire.

Who is affected: Exporters of phosphate fertilizers from Morocco and Russia face potential changes to their tariff treatment in the U.S. market. U.S. importers of these fertilizers, including distributors and agricultural retailers, will be watching the outcome closely, as removal of CVD orders could lower their landed costs.
